Introduction

Welcome to EssentialPeople. These Terms of Service ("Terms") govern your access and use of the EssentialPeople website, applications, APIs, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use our Services.

Eligibility

Recruitment Services

EssentialPeople offers recruitment and job placement services. By using our services as a job candidate, you agree that:

• All information provided in your profile, CV, and other application documents is true, accurate, and not misleading
• Have the right to work in the country where you are seeking employment
• Authorize us to share your information with potential employers
• Understand that we do not guarantee obtaining employment through our services

By using our services as an employer, you agree that:

• All information about job vacancies and your company is true, accurate, and not misleading
• Have authority to post jobs and hire on behalf of your company
• Will comply with all applicable laws related to employment, non-discrimination, and data protection
• Will not use candidate information for any purpose other than recruitment for the specific position

User Content

Our Services allow you to upload, post, send, store, or transmit content, including but not limited to text, graphics, videos, or other materials ("User Content").

You retain all rights to your User Content, but grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with the operation and provision of our Services.

You are solely responsible for your User Content and the consequences of posting it. By posting User Content, you represent and warrant that:

• Own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use the User Content
• The User Content does not violate the rights of any third party, including but not limited to intellectual property rights and privacy rights
• The User Content is not defamatory, obscene, offensive, fraudulent, or otherwise objectionable or illegal

Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of EssentialPeople and its licensors. The Services are protected by copyright, trademark, and other laws of Mozambique and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EssentialPeople.

Links to Third-Party Websites

Our Services may contain links to third-party websites or services that are not owned or controlled by EssentialPeople. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that EssentialPeople shall not be responsible, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with the use of or reliance on any content, goods, or services available on or through such websites or services.

Limitation of Liability

Under no circumstances shall EssentialPeople, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access or use or inability to access or use the Services
• Any third-party conduct or content on the Services
• Content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to defend, indemnify, and hold harmless EssentialPeople, its directors, employees, partners, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from your violation of these Terms or your use of the Services.

Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post the revised terms. Your continued use of the Services after the posting of revised Terms means that you accept and agree to the changes.

Applicable Law

These Terms will be governed and construed in accordance with the laws of Mozambique, without giving effect to any principles of conflicts of law.
